Aegis Communications Fair Use Policy

At Aegis Communications, we are committed to providing reliable, high-quality, and cost-effective Unified Communications as a Service (UCaaS) and Voice over Internet Protocol (VoIP) services to all our customers. Our service plans are designed to accommodate the typical communication needs of our business and individual users.
This Fair Use Policy (FUP) outlines the acceptable use of our services, including telephone DID (Direct Inward Dial) numbers, Caller ID, e911 services, and included minutes of usage for making and receiving calls within the continental United States. It is designed to prevent fraud and abuse of our services, ensuring that all customers can enjoy a consistent and high-quality experience.
By using our services, you agree to this Fair Use Policy.
1. Reasonable Use of Services Defined by Service Class
Our service plans are categorized into "Classes" based on anticipated monthly minute usage per active user. These classes define what constitutes "reasonable use" for your chosen plan. "Reasonable use" is based on the typical usage patterns of our customer base within each Class and does not include activities that are indicative of an attempt to avoid standard commercial charges, or that are harmful to our network or other users.
Your specific service plan will be assigned a Class (e.g., Class 1, Class 2, etc.) which is communicated to you at the time of service agreement.
Our Service Classes for Reasonable Minutes of Usage:
Class 1 Service: Designed for an average of up to 500 minutes per month per active user.
Class 2 Service: Designed for an average of up to 1,000 minutes per month per active user.
Class 3 Service: Designed for an average of up to 1,500 minutes per month per active user.
Class 4 Service: Designed for an average of up to 2,000 minutes per month per active user.
Class 5 Service: Designed for an average of up to 2,500 minutes per month per active user.
Class 6 Service: Designed for an average of up to 3,000 minutes per month per active user.
Class 7 Service: Designed for an average of up to 3,500 minutes per month per active user.
Note: The "active user" count for your organization will be determined by Aegis Communications based on the number of provisioned extensions, assigned DIDs, or other relevant metrics as defined in your service agreement.
2. Included Services and Limitations
Your service plan includes:
Telephone DID Numbers: Provision of DID numbers for inbound calls.
Caller ID: Functionality for displaying your Caller ID.
e911 Services: Provision of e911 services as required by law.
Reasonable Minutes of Usage: The ability to make and receive calls within the continental United States, as defined by your assigned Service Class.
This policy does NOT cover or allow international calls. Any attempts to make international calls using our service may be blocked or result in immediate suspension of service, and potentially additional charges.
3. Prohibited and Unreasonable Use
The following activities are considered examples of unreasonable or prohibited use and are not covered by our standard service plans, regardless of your assigned Service Class. This list is not exhaustive, and we reserve the right to determine what constitutes unreasonable use based on our sole discretion:
Excessive and Continuous Usage Beyond Class Limits: Consistently exceeding the average minute usage defined by your service Class, especially if it appears to be designed to monetize our service or leverage it as a bulk-calling solution (e.g., call centers, telemarketing, auto-dialing, broadcasting, fax blasting, or other high-volume applications) without an explicit commercial agreement for such use.
Sequential Dialing: Automated or manual sequential dialing to generate traffic or obtain call data.
Resale of Services: Reselling, rebilling, sharing, or otherwise distributing our services to third parties without prior written consent and a separate commercial agreement with Aegis Communications.
Bypassing Charges: Using our services to bypass charges that would otherwise apply, such as accessing premium-rate numbers, using automated dialing systems to generate calls for competitive advantage, or similar activities.
Network Interference: Any use that interferes with the ability of other customers to use our services, degrades network performance, or harms our network infrastructure.
Illegal or Fraudulent Activities: Using our services for any illegal, fraudulent, harassing, abusive, or unauthorized purposes.
Automated or Robotic Use: Automated or robotic calling or messaging (e.g., auto-dialers, robocallers, spam messaging) unless specifically permitted and agreed upon in a separate commercial agreement.
PBX Hacking: Allowing or enabling unauthorized access to your PBX or account that results in excessive or fraudulent calls.
4. Review of Usage and Potential Adjustments
We regularly monitor overall network usage to ensure the stability and quality of our services for all customers.
Biannually (every six months), we review client usage patterns. If a client's usage consistently and significantly exceeds the average minute usage defined by their Service Class for their active users, or demonstrates characteristics of the prohibited uses listed above, we reserve the right to:
Contact the Client: Discuss their usage patterns and understand their specific needs.
Recommend a Service Class Upgrade: Recommend transitioning to a higher Service Class plan that better aligns with their actual usage.
Apply Overage Charges: In extreme situations where usage is significantly excessive (e.g., consistently double or triple the Class limit without a reasonable explanation) and continues after discussion and warning, and where the client is unwilling to transition to a more suitable plan, we reserve the right to apply overage charges for the excessive usage. Any such overage charges will be communicated clearly and in advance.
Suspend or Terminate Service: In rare and severe cases of persistent, unreasonable, or prohibited use that impacts our network or other customers, and where other remedies have been exhausted, we reserve the right to suspend or terminate service.
5. Overage Charges for Extreme Situations
Our commitment is to provide simple and predictable pricing. Therefore, we do not charge for overages unless it is an extreme situation. An "extreme situation" is defined as usage that substantially exceeds the typical and reasonable limits of your assigned Service Class for your active users, demonstrates characteristics of the prohibited uses listed above, and puts undue strain on our network resources. We will always attempt to communicate with the client and find an amicable solution before applying overage charges.
6. Changes to this Fair Use Policy
Aegis Communications reserves the right to modify this Fair Use Policy at any time. We will provide notice of any material changes by posting the updated policy on our website or by other means as required by law. Your continued use of our services after such modifications constitutes your acceptance of the revised FUP.
